Terms & Conditions
Effective date: September 3, 2026
Last updated: September 3, 2026
These Terms and Conditions (“Terms”) govern your access to libertees.ca, your purchase of products or services from Libertees Creative Works Inc., and your use of any merchandise storefront operated or fulfilled by Libertees.
By using our website, submitting an order or accepting a quote, you agree to these Terms. If you do not agree, please do not use the website or place an order.
1. About Libertees
Libertees Creative Works Inc. (“Libertees,” “we,” “us” or “our”) is a British Columbia print-on-demand merchandise, production and fulfillment company.
Libertees produces merchandise when ordered, quality-checks completed items, packs orders and arranges delivery. We may also operate branded merchandise storefronts for participating businesses, organizations, teams, clubs and other “Liberty Partners.”
Separate written agreements may apply to Liberty Partners, sales representatives, suppliers and approved business accounts. If a separate signed agreement conflicts with these Terms, the signed agreement governs that business relationship.
2. Eligibility
You must have the legal capacity to enter a contract to place an order.
If you place an order for a company, team, club, organization or another person, you confirm that you have authority to act for them and provide any information, artwork or instructions submitted with the order.
3. Products and Availability
Products are subject to availability. Because Libertees operates a print-on-demand business:
-
Merchandise may not be produced until an order is received;
-
Standardized blank products are used unless another option is approved;
-
Specialty blanks, non-standard products and special handling may cost more;
-
Product colours, fabrics, sizing and availability may change;
-
A substitute will not be used where it materially changes an approved order without informing you; and
-
We may discontinue or replace a product before accepting an order.
Photographs and digital mockups are provided as accurately as reasonably possible. Screen settings, fabric characteristics and normal production tolerances may cause minor differences in colour, placement, texture or appearance.
Customers are responsible for reviewing applicable product descriptions and size charts before ordering.
4. Canadian Identity and Responsible Sourcing
Libertees is a Canadian company that performs its core merchandise production and fulfillment work in Canada.
The words “Canadian Made” used within the Libertees corporate logo communicate our commitment to Canadian production and to using Canadian products, suppliers and labour where they are reasonably available, commercially practical and consistent with responsible sourcing, quality and safety.
This commitment does not mean that every blank garment, fibre, raw material, accessory, component, ink, package or piece of equipment is manufactured entirely in Canada. Some products or components may be imported or contain imported materials.
The country-of-origin information provided for an individual product takes precedence over the general corporate statement. Where Libertees makes a specific “Made in Canada” or “Product of Canada” claim about a product, we will provide any qualification required by applicable Canadian law.
5. Custom Artwork and Product Approval
Customers and Liberty Partners are responsible for reviewing all proofs, mockups, samples, spelling, names, numbers, colours, sizes, quantities and placement details before approval.
A Liberty Partner must approve the applicable sample or product line before merchandise is placed live for sale.
Once approval is given:
-
Libertees may begin production;
-
Changes may not be possible;
-
Additional work or replacement products requested because of an approved design may result in additional charges; and
-
Libertees is not responsible for an error that appeared in the approved proof or instructions unless the completed product differs materially from what was approved.
Approval of a digital proof does not guarantee that colours displayed on a screen will reproduce identically on fabric or another physical material.
6. Customer-Provided Content
You retain ownership of artwork and other content you submit.
You grant Libertees a limited, non-exclusive licence to copy, resize, adjust, separate, reproduce and otherwise use submitted content only as reasonably necessary to:
-
Prepare proofs and samples;
-
Produce merchandise;
-
Operate the applicable storefront;
-
Complete and support orders; and
-
Maintain legally or operationally necessary records.
Libertees will not use a customer’s private artwork for unrelated advertising or promotional purposes without permission.
You represent that:
-
You own the submitted content or have permission to use it;
-
Our use of it will not violate copyright, trademark, privacy, publicity or other rights;
-
It is not unlawful, fraudulent, defamatory or misleading; and
-
Any personal information about another person was collected and provided lawfully.
You are responsible for claims resulting from content you were not authorized to provide.
7. Prohibited Content and Conduct
Libertees may refuse content or conduct that we reasonably believe:
-
Is unlawful or promotes unlawful activity;
-
Infringes intellectual-property or privacy rights;
-
Is threatening, harassing, defamatory or fraudulent;
-
Promotes hatred or violence against an identifiable person or group;
-
Contains sexual exploitation or abuse;
-
Creates a safety or security concern;
-
Impersonates another person or organization;
-
Misrepresents an affiliation, endorsement or product origin;
-
Is intended to deceive customers or the public; or
-
Would expose Libertees, its staff, partners or service providers to unreasonable legal, financial, reputational or operational risk.
8. Right to Refuse Service
Libertees reserves the right to decline an inquiry, design, order, account, partnership, representative relationship or other request before acceptance.
After acceptance, Libertees may suspend or cancel an order or service where reasonably necessary because of:
-
A violation of these Terms;
-
Suspected fraud, abuse or unlawful activity;
-
An intellectual-property or privacy concern;
-
Threatening, abusive or unsafe conduct;
-
A pricing, inventory or technical error;
-
An inability to obtain materials or complete the work responsibly;
-
A legal or regulatory requirement;
-
Prohibited content; or
-
A specific requested message, image, design, campaign or cause that Libertees reasonably considers inconsistent with its ethical standards, company values or sincerely held beliefs.
A content-based refusal concerns the particular work requested and does not necessarily reflect a judgment about the person or organization making the request.
Libertees will exercise this right lawfully. We will not refuse service because of a customer’s identity or another characteristic protected by applicable human-rights legislation.
If Libertees cancels a prepaid order, we will refund amounts paid for the cancelled and unprovided portion, subject to applicable law and any lawful claim arising from fraud, chargebacks or other customer misconduct.
The exercise of this right is without prejudice to Libertees’ other lawful rights and remedies and does not limit any non-waivable rights of the customer.
9. Orders and Contract Formation
Submitting an order is an offer to purchase. An order is accepted when Libertees sends confirmation that the order has been accepted or begins production, whichever occurs first.
An automated acknowledgement that we received an order does not necessarily mean the order has been accepted.
Before completing an online purchase, customers will have an opportunity to review the order, correct errors and accept or decline the transaction.
We will provide an electronic confirmation or copy of the accepted order to the email address supplied by the customer within the period required by law.
We may contact you to correct an obvious pricing, product or technical error before accepting an order. If an accepted prepaid order must be cancelled because of such an error, the affected amount will be refunded.
10. Prices, Taxes and Payment
Unless stated otherwise:
-
Prices are displayed and charged in Canadian dollars;
-
Applicable taxes and shipping charges are added before purchase;
-
The complete amount payable will be displayed before an online order is submitted; and
-
Payment is required before production begins unless Libertees has approved a business account for month-end invoicing.
Approved business accounts are subject to their applicable quote, invoice and account terms. Failure to pay an invoice when due may result in suspension of further production or fulfillment.
Promotional offers, discount codes and special pricing may have separate eligibility requirements, expiry dates and restrictions. They cannot be combined unless expressly stated.
11. Production Times
Our general production targets are:
-
Approximately 2–3 business days for in-stock products; and
-
Approximately 3–7 business days for sourced products before carrier transit.
These are production targets rather than guaranteed completion or delivery dates. Larger orders, specialty products, material shortages, artwork delays, approval delays and events beyond our reasonable control may require additional time.
The estimated supply or delivery timing applicable to a specific order will be shown or communicated during the ordering process.
12. Shipping and Delivery
Libertees uses regional shipping charts and selects delivery providers based on service availability, suitability and price.
Shipping rates are reviewed every three months and may also be reviewed when major carrier, fuel, market or operating-cost changes occur. A change made after an order is accepted will not alter the shipping charge already confirmed for that order unless the customer approves the change.
Delivery estimates begin after production is complete and are not guarantees unless expressly confirmed in writing.
Customers must provide an accurate and complete delivery address. Additional delivery costs caused by an incorrect address, refused delivery or repeated unsuccessful delivery attempt may be charged where permitted by law.
For shipments outside Canada, customs duties, brokerage fees and import charges may apply. Any known charges will be disclosed before purchase, while charges that cannot reasonably be determined in advance remain the customer’s responsibility unless stated otherwise.
Libertees remains responsible for meeting any delivery and cancellation obligations that cannot legally be excluded.
13. Cancellations and Order Changes
Because products are made or customized to order, an order generally cannot be changed or cancelled after production begins.
Before production begins, contact us as soon as possible. We will determine whether the requested change or cancellation can reasonably be accommodated.
Any additional work, products or materials required by a customer-requested change may result in additional charges, which will be disclosed before the change is completed.
Nothing in this section limits a cancellation right provided by applicable consumer-protection legislation.
14. Returns, Defects and Production Errors
Customized and print-on-demand products are generally final sale and are not returnable because of:
-
A change of mind;
-
Incorrect size selection;
-
Preference concerning an approved colour, design or placement;
-
An error contained in an approved proof; or
-
Normal and minor production variation.
Libertees is responsible for confirmed production defects, damage attributable to our production or packing, incorrect items, and Libertees printing errors.
If an item arrives damaged, defective or materially different from the approved order, contact orders@libertees.ca as soon as reasonably possible. Include the order number, a description of the issue and photographs where appropriate.
Depending on the circumstances and applicable law, Libertees may:
-
Reprint or repair the item;
-
Replace the affected item;
-
Provide a refund or credit; or
-
Offer another reasonable resolution.
Do not return merchandise until Libertees provides return instructions. Libertees will cover reasonable return costs where required by law or where the return results from a confirmed Libertees error.
These Terms do not remove statutory rights relating to defective, misrepresented or undelivered goods.
15. Liberty Partner Storefronts
A storefront may display a Liberty Partner’s name, logo and merchandise while Libertees handles production, fulfillment and customer support.
The Liberty Partner does not manufacture the merchandise unless expressly stated.
Commission, revenue-sharing and representative arrangements are governed by separate agreements and do not create rights for merchandise customers.
The Privacy Policy explains how customer information may be handled in connection with a Liberty Partner storefront.
16. Website Accounts and Security
You are responsible for:
-
Providing accurate information;
-
Protecting account credentials;
-
Restricting unauthorized access to your account; and
-
Notifying us promptly of suspected unauthorized activity.
We may suspend an account where reasonably necessary to protect customers, Libertees or our service providers.
17. Website Content and Intellectual Property
Unless otherwise stated, the Libertees website, logo, graphics, photographs, layout, text and original content are owned by or licensed to Libertees.
You may use the website for personal or authorized business purchasing. You may not reproduce, scrape, resell, alter or commercially exploit our website content without written permission.
Liberty Partner trademarks and artwork remain the property of their respective owners.
18. Privacy
Our collection, use, disclosure, protection and retention of Personal Information are governed by the Libertees Privacy Policy, which forms part of these Terms.
19. Third-Party Services and Links
Our website may use or link to third-party payment, delivery, social-media or technology services.
Independent third parties may have their own terms and privacy practices. Libertees is not responsible for an independent third party’s website or conduct, but this does not remove any responsibility Libertees has under applicable law for service providers acting on our behalf.
20. Service Interruptions and Events Beyond Our Control
Libertees is not responsible for a delay or failure caused by an event beyond our reasonable control, including natural disasters, wildfire, severe weather, labour disruption, carrier interruption, utility or internet failure, government action, supply shortage or widespread equipment failure.
We will take reasonable steps to communicate material delays and resume performance. This section does not eliminate cancellation, refund or other rights that cannot legally be excluded.
21. Limitation of Liability
Nothing in these Terms excludes liability or customer rights that cannot be excluded under applicable law.
To the extent permitted by law, Libertees is not liable for indirect, incidental or consequential losses arising from a delayed or unsuccessful business promotion, lost anticipated revenue, or a customer’s unauthorized artwork.
For a business customer, Libertees’ aggregate liability relating to an order will generally not exceed the amount paid for the affected order, except where a greater remedy is required by law or the loss resulted from fraud, wilful misconduct or gross negligence.
22. Governing Law
These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada.
Disputes may be brought before a court or tribunal with lawful jurisdiction. Nothing in these Terms prevents a consumer from exercising a right or remedy available under applicable consumer-protection legislation.
23. Changes to These Terms
We may update these Terms prospectively when our operations, products or legal obligations change.
The Terms in effect when an order is accepted will govern that order. A later change will not reduce a customer’s rights or materially change an existing accepted consumer contract unless the customer agrees or the change is required by law.
24. Severability and No Waiver
If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure by Libertees to enforce a provision on one occasion is not a waiver of the right to enforce it later.
